What Sentence Does Common Assault Carry?
A person found guilty of common assault in England or Wales can receive a financial penalty, a community order, or a prison sentence. A prison sentence can either be suspended or immediate and the maximum prison sentence is 6 months.
Cases of racially or religiously aggravated common assault, however, can be heard in the Crown Court which affords greater sentencing powers. The maximum sentence for these cases, therefore, is two years’ imprisonment.
