Disclosing private sexual photographs and films with intent to cause distress
Contrary to Section 33, Criminal Justice and Courts Act 2015
This offence is committed when a person discloses a private sexual photograph or film if the disclosure is made without the consent of an individual who appears in the photograph or film, and with the intention of causing that individual distress.
How Can You Fight A Revenge Porn Allegation?
Although the act that comprises what is now known as revenge porn has been criminalised by other legislation, the creation of the specific offence has created a fresh focus on prosecuting cases such as these.
If you are charged with revenge porn, you will need specialist revenge porn solicitors to review the evidence, hear your side of the story and advise whether you should plead guilty or not guilty. We will also be able to advise how strong any defence you may have appears to be.
What Is Revenge Porn?
Revenge porn is the sharing of private, sexual images or videos of another person without their consent and with the intention of causing that person embarrassment of distress.
The offence applies online and offline and includes materials shared electronically or in more old-fashioned ways such as physically showing someone a photograph of video.
Is Revenge Porn New?
The act of sending sexual images has not only just been criminalised. It has long been prosecuted under the Communications Act 2003 or the Malicious Communications Act 1988 and, if repeated, the Protection from Harassment Act 1997.
In April 2015, however, a new law specifically focused on tackling revenge porn was introduced. This law has seen over 200 prosecutions in the last year.
What Does “Sexual” Mean?
The requirement that the images or videos in question be of a sexual nature can, of course, include anything showing a person’s genitals. It can also, however, include sexual acts or a person posing in a sexually provocative way.
Can women be charged with revenge porn?
Yes. As the offence requires the sharing of private, sexual images, the person who will be charged is the person who has shared the images. This can be a male or female. The majority of revenge porn cases involve images or videos of a woman shared by a man, but women have been prosecuted for this offence.
What is the penalty for Revenge Porn?
Revenge porn cases are triable either way, meaning they can be heard in the magistrates or Crown Court. Various factors will help the Court decide what is the appropriate way to hear the case.
The penalty for Revenge Porn cases is a maximum of two years’ custody.
