Claire was on 9 points when she was caught speeding by a fixed camera. She had already completed a Speed Awareness Course within the last three years and therefore she was going to accrue a further 3 points and be in a totting up position.
If anyone accrues 12 points or more on their licence they will automatically fall to be disqualified for 6 months under the totting up provisions unless they can conduct a successful Exceptional Hardship application.
While anyone can make these applications, they are certainly not easy to make as you are admitting guilt to an offence but then asking to not be punished as you should be. Â The Court don’t rush to agree to this!
Claire owned a business selling e-cigarettes, and had many shops across the country. It was a small business, therefore, Claire had to be on standby at all times in case any emergencies came up regarding staffing issues or running out of stock. Because Claire had to carry large volumes of stock, relying on public transport was not an option.

Steve managed to persuade the court to sentence Claire by way of a 14 day disqualification, giving Claire back a clean driving licence after the 14 days, rather than plead Exceptional Hardship.
